5. Terms and Conditions of Sale and Website Use
5.1 About these terms
These Terms govern access to the Dormeluna website and purchases made through the store. By placing an order, the customer confirms that they have read and accepted the policies made available before checkout.
5.2 Product information
Dormeluna aims to describe and display products accurately. Colours and appearance may vary slightly because of screen settings, photography and normal manufacturing tolerances. Product dimensions may be subject to minor reasonable variation.
Any statements concerning comfort, support or sleep experience describe the intended product design and general use. Individual experiences vary. Dormeluna products are not medical devices and are not intended to diagnose, treat or cure a medical condition. Anyone with persistent or severe pain should seek advice from an appropriately qualified healthcare professional.
5.3 Orders and contract formation
Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily mean the order has been accepted. Acceptance occurs when Dormeluna confirms dispatch or otherwise expressly accepts the order.
Dormeluna may refuse or cancel an order for legitimate reasons, including product unavailability, payment failure, suspected fraud, delivery restrictions or an obvious error. Any payment already taken for a cancelled order will be refunded.
5.4 Prices, taxes and promotions
Prices and applicable taxes are displayed before checkout. Promotional offers are subject to their stated conditions, availability and end date. Unless expressly stated, discount codes cannot be combined or applied retrospectively.
5.5 Delivery and returns
The Shipping Policy and Returns, Withdrawal and Refund Policy form part of these Terms.
5.6 Intellectual property
The website, Dormeluna branding, logos, product photography, graphics, copy and other original content are protected by intellectual property laws. They may not be copied, modified, distributed or used commercially without permission from the relevant rights holder.
5.7 Acceptable website use
Users must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with store operation, scrape content unlawfully or use the service for fraud or illegal activity.
5.8 Third-party services and links
The store may use third-party providers for hosting, payments, delivery, analytics, marketing or customer support and may link to third-party websites. Those parties may have their own terms and privacy practices. Dormeluna is not responsible for third-party content outside its reasonable control, without limiting any responsibility that cannot legally be excluded.
5.9 Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including mandatory consumer rights. Subject to those rights, Dormeluna is not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase.
5.10 Events outside reasonable control
Dormeluna will not be responsible for delay or failure caused by circumstances outside its reasonable control, but this does not remove any statutory rights the customer has if delivery is excessively delayed or cannot be completed.
5.11 Governing law and disputes
These Terms are governed by Spanish law. Consumers also retain any mandatory protection granted by the law of the country in which they habitually reside.
Customers should first contact Dormeluna through the Contact page so that we can try to resolve a complaint. Consumers may also contact the competent consumer authority or an appropriate alternative dispute resolution body available in their country.
5.12 Changes to these terms
Dormeluna may update these Terms prospectively when the store, technology or law changes. The version applicable to an order is the version available when that order was placed, unless the law requires otherwise.
